New FML Provisions Effective Immediately

On January 28, 2008, the National Defense Authorization Act (H.R. 4986) was signed into law. Included in the Act (Title V, Section 585, page 295) is an expansion to the Family and Medical Leave Act, creating new leave entitlements for employees who have a family member injured in service or called to active duty.

The law is effective immediately, and implements two (2) new types of Family Medical Leave (FML):

• Leave to care for wounded service member.
  Eligible employees may take up to 26 weeks of leave to care for spouses, children, parents or next kin who are service members with serious illnesses or injuries that were incurred during active duty in the Armed Forces.
• Leave related to active duty or call to duty.
  Eligible employees may take up to 12 weeks of FMLA leave in a 12 month period to deal with any "qualifying exigency" that arises from a spouse's, child's or parent's active duty in the Armed Forces, including an order or call to duty.

Once the new language contained in the National Defense Authorization Act has been analyzed it will be added to the CSU FML Policy.
